Terms & Conditions 

The following sections explain the rules which govern all transactions that are effected through Sky Bet, Sky Bingo, Sky Poker and Sky Vegas websites, Interactive TV and WAP mobile and other forms of telephone. They are applicable from 22nd August 2011.

Please read the terms carefully and ensure you understand them fully. By registering an account you will be deemed by us to have understood and accepted these terms and agree to be bound by them. In these terms, "we" and "us" are Bonne Terre Limited (a company registered in Alderney with registered company number 1110 and offices located at 41 Victoria Street, Alderney, Channel Islands, GY9 3TA), as the case may be, trading as Sky Bet, Sky Vegas, Sky Bingo and Sky Poker.

Bonne Terre Limited is licensed and regulated by the Alderney Gambling Control Commission.

Sky Vegas mobile casino games are delivered by Million-2-1 Limited, a company licensed and regulated in the UK by the Gambling Commission.

From time to time, certain provisions of the terms will change and will be updated accordingly. Notification of each such change will be published on our web sites (www.skybet.com, www.skyvegas.com, www.skybingo.com and www.skypoker.com). Each change will become effective and you will be deemed to have accepted such changes, immediately upon such change being posted.

In the interests of customer and staff protection and to assist us in resolving queries, all telephone calls to our Customer Contact Team are recorded.

Opening an account

You must be at least 18 years old in order to register and use the Sky Bet, Sky Bingo, Sky Poker and Sky Vegas Services. It may be an offence for you to participate in gambling if you are under 18 years of age. If you are located in the United Kingdom and you are under 18 years of age, you are committing an offence if you use our services.

You are responsible for ensuring that it is legal to participate in remote gambling from within your country.

To have access to our products and services you must open a deposit account. Customers may only bet up to the amount deposited in their account as we do not operate credit accounts.

All amounts paid into your account must be by debit card (Visa, Maestro, Delta, Electron or Laser) or credit card (MasterCard, Visa) or using an accepted online payment service.

You can register only one Sky Bet, Sky Bingo, Sky Poker, Sky Vegas account which can be used on all products.  Should we find that you have opened multiple accounts we will close all but one account.

It is your responsibility to inform us of any changes to your personal/banking details which may impact upon the use of your account e.g. change of address, bank card details, etc.  If any of these details change, please notify us using the facility provided on our websites.

The minimum account deposit is £ 5.00 (or currency equivalent).

We reserve the right to refuse to open an account for any reason provided that we shall notify you of our decision as soon as reasonably possible after you have applied to register your account.

Managing your account

When using a debit card, credit card or alternative form of payment, you must make sure that it is registered in your name.  We are entitled to assume that you are using your own method of payment and we accept no liability to any third party whose method of payment you may have used. The maximum number of payment methods that may be registered on any individual account at any given time is three cards and one e-wallet. If you wish to change the active payment method at any time, your account balance must be zero. To change your payment method please use the facility provided on our website or contact our Customer Contact Team.

As well as any other verification processes we may undertake, you may be required to provide additional proof of identity to assist with age verification before making their first deposit. If requested, you will need to send us a copy of your passport, driver's licence or birth certificate for these purposes. These documents must be mailed or faxed to us at:

Whilst these additional checks are not generally required for credit card users, we reserve the right to request such documentation prior to processing a withdrawal, should circumstances dictate.
 
If you access any of the products and/or services available on Sky Bet, Sky Bingo, Sky Poker and Sky Vegas websites, over the internet or through WAP mobile or other forms of wireless device,  from a country other than the country specified as your country of residence in the customer registration procedure, then it is your responsibility to check that accessing and using such products/services is not prohibited and/or restricted by local laws.
 
If any sum is incorrectly credited to your account you are obliged to notify us and we are entitled to reverse such credits and/or recover such sums from you (with interest) if withdrawn.  If you use the sums improperly credited to place bets, the Company can void all such bets and reverse any winnings.

No charge is applied by us for withdrawals to a UK debit or credit card or to international Visa cards. For international MasterCards and Visa cards issued in restricted countries, withdrawals by bank transfer to banks located outside the UK or in a foreign currency will incur a fee of the currency equivalent of £ 5, which will be deducted from the amount withdrawn.

Sky Betting and Gaming retains the right to change minimum deposit and withdrawal levels without prior notice.

At our discretion requests for withdrawals may be held for approval before being processed.

Funds in your account shall not entitle you to interest.


Freezing and Closing an account

In certain circumstances, we may need to freeze the monies in your account so that such funds will be temporarily unavailable for you to play with.  We will do so where we have reason to believe that your account may be being used for fraudulent purposes, for the purposes of money laundering or in such a way as to jeopardise the integrity of the sports or events on which we offer betting markets.  Until our investigations are completed and until we are satisfied that the cause of our concerns no longer exists we may continue to freeze the account or opt to close it.  We may also freeze or close your account if we believe you are involved in collusion, match rigging or cheating of any kind or if we have reason to believe you are under 18 years old or in a jurisdiction that renders the provision of our products or services to you or your use of them illegal.

We reserve the right to close a Customer's account at any time.  We will give you reasonable notice before doing so, unless circumstances dictate that we legally or practically cannot do so.

You have the right to close an account at any time. A request to close an account should be in via the telephone or writing via e-mail, fax or letter, see our Contact Us section for details. In this case, you shall be sent the sum on deposit in your account by a method of payment determined by us. Should you have placed bets, the outcome of which is as yet unknown, and which subsequently win, the corresponding sums shall be sent later when the bet is completed.


Credit Checking and Age Verification

When deciding whether to accept your registration or when you notify us you wish to use another payment method with your account, we may supply the information you have given us to authorised credit reference agencies to confirm your identity and payment details. They will check any details we disclose to them against any databases (public or private) to which they have access and will keep a record of that check. You agree that we may process, use, record and disclose personal information which you provide in connection with your registration and that such personal data may be recorded by us or them.

We are entitled to verify any information you give us when you open an account to ensure you are over the age of 18 and we may ask you to provide us with proof you are over 18.   You will not be able to withdraw any winnings until our verification process has been satisfactorily completed. In any event, if you have failed to satisfactorily complete our age verification checks within 72 hours of you applying to register, we are entitled to freeze your account, prevent you from gambling until you have satisfactorily completed these checks and, if upon completion of age verification you are ultimately shown to be underage, we will return all stakes to you but are under no obligation to pay any winnings.


User ID, PIN and Customer Information

You are asked to select a unique User ID along your own choice of PIN. It is your responsibility to ensure you do not reveal your User ID and PIN to anyone else. You are responsible for any  bets and wagers made where your User ID and PIN have been entered correctly.

It is your responsibility to maintain the secrecy and security of your account information and PIN. We are not responsible for the unauthorised use of accounts or any losses that may result from such use and bets or wagers placed by third parties aware of these details will be considered valid.

Should you have forgotten your User ID or PIN you can retrieve the details using the appropriate tools provided on our websites, alternatively you may contact our Customer Contact Team by telephone and we will reset them for you. If you forget or lose your User ID or suspect that someone else has learned of your unique number, you must contact the Customer Contact helpline immediately.

We reserve the right to use the names of customers in such publicity as we may reasonably require.


Confirming your bets

Any request by a customer to change or cancel a bet can only be agreed with mutual consent.

By confirming a bet during the bet acceptance stage you acknowledge that your selections have been captured as per your requirements.

Internet and Interactive TV wagers and bets are not guaranteed unless you receive an on screen receipt from us which is confirmation that the wager/bet is accepted, except in the case of Sky Vegas games.  For Sky Vegas games, once you have confirmed the wager details and started the game, your wager will be deemed to have been accepted. If you have any doubts about whether your bets/wagers have been accepted, you should view your account history.

Please note that multiple returns shown on the bet slip are maximum potential returns, i.e. the most you can win. When a single dividend is part of the multiple, potential returns cannot be calculated and “n/a” is displayed in it's place.

Should the company decide to waive a rule in the interest of fair play to a customer it will not set any precedent for the future.

We reserve the right to refuse the whole or any part of a bet along with the right to close an account.

Gambling is a fast moving environment, odds move rapidly and bets are taken continuously and consequently mistakes do occasionally occur.  We do all that we can to avoid this but we cannot accept responsibility for any obvious errors or omissions in respect of the announcing, publishing or marking of prices, the late closing of markets, place terms, handicaps, runners or results despite our every effort to ensure total accuracy.  If a bet is accepted in error by us at a price or market condition, as indicated above, that is:
         
          - Materially different from those available in the general market at the time the bet was made or
          - So obviously incorrect given the relative probability of the event occurring at the time the bet was made or
          - So obviously incorrect having regard to the nature of the betting business or the market in question (including if we erroneously accept a bet after the 
          event in question has commenced (unless it is an in-running bet)),

then we will not pay winnings higher than those that would be paid under the price available in the general market and we will either settle the bet at the correct price or on terms available with us or, on condition that you can provide us with verification, at the best price or on the best terms available with any of the following companies at the time the bet was struck: Ladbrokes, William Hill, Totesport or Betfred.

In any circumstances where a bet is deemed to be or is declared void under these terms, any sum deducted from your account in respect of that bet shall be credited to your account.

The minimum bet is 5p (or currency equivalent). The maximum bet per selection is determined by Sky Bet.  The minimum and maximum bet size on Sky Vegas games will vary from game to game and is displayed on screen. The minimum stake for Sky Bingo varies by which game you play. Please refer to the bingo rooms for more information.

Any malfunction to our systems voids pay and plays on all games. Furthermore, it is a condition that you notify us of any such malfunction as soon as possible.


Promotions and advertised offers

Certain promotions may be subject to withdrawal or cancellation and may only be available for specific periods and on certain specific terms.  You must ensure that the promotion you are interested in is still available, that you are eligible, and that you understand any terms which apply to it.

Advertised offers relating to the opening of an account are limited to one per Customer. In the case of a Customer opening more than one account or otherwise abusing a promotional offer, we reserve the right in our sole discretion to suspend and close duplicate accounts, withdraw any applicable bonus sums and make void any bets placed.

For all promotions, if the bonus is unused for 30 days it will be withdrawn.
 
In the event that we conduct any competitions, prize draws or similar promotions (including via any social media sites controlled by us), any potential winner who has at the time of the winners’ selection either self-excluded themselves from using our products and services and/or closed their relevant account with us will not be an eligible winner and will not be eligible to receive any form of prize or award.


Complaints and disputes

If you have any cause to complain about anything that has happened as a consequence of your dealings with us, you should notify us by contacting the Customer Care Team who will oversee the management of your complaint. We will deal with your complaint as quickly as we reasonably can and shall, as necessary, request appropriate evidence from you for the purposes of settling your complaint.

If a complaint is not resolved to your satisfaction by the use of our complaint procedure, you may refer the matter to an independent adjudicator.  The appropriate adjudicator is determined by reference to the products or services that are the subject of the dispute or by the regulator of the product in question. We will inform you which body to refer to, upon request. Where a dispute is referred to one of the bodies mentioned below, the resulting decision shall be final and binding and you therefore will not have further recourse to the courts.

Complaints relating to Sky Bet sports betting and virtual racing may be referred by you to the Independent Betting Arbitration Service (IBAS) through the website www.ibas-uk.com, by email at postmaster@ibas-uk.co.uk or by telephone on +44 (0)20 7881 2690. We will abide by any IBAS decision, provided all relevant information has been accurately provided to them. For the avoidance of doubt, with respect to any complaints relating to bets placed on or after 27 July 2009, customers will also be able to refer complaints to the Alderney Gambling Control Commission (as set out below) if they not feel the matter has been satisfactorily resolved by IBAS.

Complaints relating to Sky Vegas, Sky Bingo or Sky Poker may be referred to the Alderney Gambling Control Commission (AGCC) following the complaints procedure set out at www.gamblingcontrol.org, info@gamblingcontrol.org or by telephone on +44 (0)1481 825500


Fraud and cheating

Any form of fraudulent activity, as determined at the Company's sole discretion, is strictly prohibited. Fraudulent activity may include, but is not limited to, stolen credit cards, transfer/receipt of funds to other player accounts (chip dumping), forgery, collusion, cheating, money laundering and the provision of false registration data or other requested information. If any player is found to be participating in any form of cheating, collusion or fraudulent activity, his or her account may be permanently closed and any funds in his or her account may be withheld and legal proceeding may be brought against the players in question.

Any account balance may also be used to finance the Company's costs incurred by the fraudulent activity, such as chargebacks on associated accounts. 
          
          - We reserve the right to refuse all any part of a bet offered to us, void any accepted bets and withhold settlement if we have reason to believe:
          - You are under 18 years of age
          - You are involved in fraud, money laundering, collusion, match rigging or cheating of any kind 
          - You are in a jurisdiction (or citizen of a jurisdiction) that renders the provision of our products or services to you or your use of them illegal or
          a bet or wager may breach the governing rules of the relevant sport or event in question or jeopardise the integrity of the sport or event in question.

Where we have taken the steps to void a bet or wager for one of the above reasons, your actions leading to that shall be considered a breach of these Terms and Conditions and entitle us to terminate our relationship with immediate effect.

The Customer shall indemnify and shall be liable to pay us, on demand, all costs, charges or losses sustained or incurred by us (including any direct, indirect or consequential losses, any loss of profit and loss of reputation) arising directly or indirectly from a Customer's fraud, dishonesty or criminal act.

You are required to provide us with accurate information in relation to the opening and management of your accounts. Furthermore we will assume that you are betting on your own account and not for a third party unless you inform us in advance.  Any breach of this provision will enable us to close your account with us.
 

Manipulation and Unfair Play 
 
You will not in any way interfere, interrupt, attempt to interrupt, or attempt to manipulate the operations of our web sites or the normal play of any of the games, services or products. Failure to comply with this rule may lead to your exclusion from our web sites without any compensation and to possible criminal and civil investigations. In particular, you will not use or attempt to use any artificial intelligence or player assistance software but will play personally via the interfaces provided by us only. 
 

Dormant accounts

Should your account become dormant, through lack of use, we will continue to contact opted-in accounts with promotional messages until such time as you instruct us to stop. However we will also contact all account holders periodically to advise of any account balance. Please note that after a period of no less than 24 months of account inactivity we reserve the right to close dormant accounts and to remove any funds.


Responsible gambling

We make available the facility for you to set a limit on the deposits you make to your account. Information on setting limits may be found within the Help and Support section or within the My Account pages when logged in to our services.

We make available the facility for you to stop gambling at any time. 24 hour cooling off periods as well as self exclusions of either 6 months, 1 year, 2 years, 3 years, 4 years or 5 years can be set. Having implemented reasonable checks and safeguards to ensure that whilst you are self excluded you are not sent marketing material about gambling from us and you cannot access our Website(s) s we cannot be held liable to you or any third party if you are able to continue to gamble on our site(s), or if any marketing material inadvertently gets sent to you or if you continue to gamble on any other party's sites or premises. Moreover we would urge you if you continue to gamble during any period of self exclusion (from ourselves or other operators) that you seek urgent professional help

We will use all reasonable endeavours to ensure compliance with self-exclusion.  However you accept that we have no responsibility or liability whatsoever if you continue to gamble through additional accounts where you have changed any of the registration details (which would also include if you open up an account with substantially the same information, albeit inputted into the registration form in a different way)


Liability

We are only obliged to pay out winnings that have been genuinely won in accordance with our Terms and Conditions. Any malfunction to any of our games and products will result in a bet or wager being rendered void.

You accept that our products and services and the corresponding Websites upon which they are available are provided to you "as is" with any faults or failings and any representation, warranty, condition or guarantee whatsoever, express or implied (including, without limitation, any implied warranty of accuracy, completeness, uninterrupted provision, quality, merchantability, fitness for a particular purpose or non-infringement) excluded to the fullest extent permitted by law.

Under no circumstances (including, without limitation, negligence) are we liable for any injury, loss, claim, loss of data, income, profit or opportunity, loss or damage to property, general damages or any direct, indirect, special, incidental, consequential, exemplary or punitive damages of any kind whatsoever arising out of or in connection with any Customer's access to, or use of, or inability to use, our products and services and the corresponding Websites or any of our chat rooms, any software, any materials or other information on our Website or any goods, materials or services available therefrom (whether based in contract, tort and whether negligent or otherwise), even if we have has been advised of the possibility of such damages or loss or that such loss was foreseeable.

You specifically acknowledge, agree and accept that we are not liable to you for:-
          - the defamatory, offensive or illegal conduct of any other Customer
          - any loss whatsoever arising from the use, abuse or misuse of your account or any of our products and services and the corresponding Websites 
          - any loss incurred in transmitting information to our Websites by the internet or by e-mail
          - any technical failures, system breakdowns, defects, delays, interruptions, manipulated or improper data transmission, loss or corruption of data or 
          - communications' lines failure (including any failures that affect the ability for interactive television return-path capabilities), distributed denial of service 
          - attacks, viruses or any other adverse technological consequence of your choosing to use our products and services
          - the accuracy, completeness or currency of any information services provided (including, without limitation, prices, runners, times, results or general 
          statistics) or any live scores, statistics and intermediate results shown on our Websites
          - any failure on our part to observe any self-exclusion policies that we may have in place from time to time and
          - any failure on our part to interact with you where we may have concerns about your activities.

Nothing in these Terms and Conditions shall operate so as to exclude or restrict our liability for death or personal injury caused by our negligence.
